1. Introduction

Welcome to Formby Bubble®, a local community service owned and operated by Formby Bubble Limited.

These Terms and Conditions (“Terms”) apply to your use of:

Our website (www.formbybubble.com)
Our mobile application (“the App”)
Our social media pages and groups (“Social Media”)

Together, these are referred to as “the Service.”

By accessing or using the Service, you agree to follow these Terms. If you do not agree, please stop using the Service immediately.

We may update these Terms at any time. Changes will be posted on our website or App. Continuing to use the Service means you accept the updated Terms.

2. Registration & Accounts

To access some features, you may need to register for an account. By doing so, you agree to:

Provide accurate and current information.
Keep your login details secure.
Accept responsibility for all activity under your account.

We may suspend or close accounts that breach these Terms.

3. Content & Intellectual Property

Our content: All text, images, logos, graphics, and layouts are owned by or licensed to Formby Bubble Limited. You may not copy, reproduce, or use them commercially without permission.
Your content: You remain the owner of anything you post (photos, text, videos, etc). By posting, you give Formby Bubble a licence to use, display, and share your content across our platforms (website, App, and social media) for community and promotional purposes.

We may edit or remove content that breaks these Terms or our Community Guidelines.

4. Trademarks

Formby Bubble® is a registered mark. Our name and logo may not be copied, used, or imitated without written permission.

5. User Conduct

You agree not to use the Service to:

Harass, abuse, or threaten others.
Post unlawful, defamatory, obscene, or discriminatory content.
Share misleading appeals, scams, or unauthorised fundraising.
Upload viruses or attempt to disrupt the Service.
Share private or identifying information about others without consent.
Pretend to be another person or misrepresent your role.

You must also follow our Community Guidelines, available in the App and on our website.

6. Lost & Found, Appeals & Fundraising

Lost & Found posts must include clear details and photos where possible. Owners of found items may be asked to provide proof before collection.
Appeals & fundraising: We require proof of legitimacy before publishing (e.g. charity registration number, official school email, or JustGiving/GoFundMe link). Appeals without proof will not be posted.
Formby Bubble is not responsible for the outcome of any donation, fundraiser, or private arrangement made through the Service.

7. Business & Organisation Accounts

Business & trader profiles: Only authorised representatives may create accounts.
Bubble Approved Traders®: To receive this status, businesses must pass our verification process.
Organisations are responsible for their own content, services, and compliance with laws.

8. Privacy & Data

We respect your privacy.

We may collect limited personal data (name, email, postcode, posts, photos) to operate the Service.
We may use this data to send updates, notifications, and community news.
We do not sell your data to third parties.
Data may be securely stored and processed in the UK or EU.

9. Third-Party Links

The Service may contain links to other websites or social platforms. We are not responsible for the content or practices of those third parties. Use them at your own risk.

10. Disclaimers

We try to ensure information is accurate, but cannot guarantee completeness or reliability.
User-generated posts do not necessarily reflect the views of Formby Bubble.
The Service may occasionally be unavailable due to maintenance or technical issues.
We are not responsible for harm, loss, or damage caused by use of the Service, except where required by law.

11. Limitation of Liability

To the maximum extent permitted by law:

Formby Bubble Limited, its directors, and staff will not be liable for indirect or consequential damages.
Our total liability to you will not exceed £100 or the amount you have paid us in the last 12 months (whichever is greater).

We may suspend or terminate accounts, remove content, or restrict access at any time if you breach these Terms or act in a way that may cause harm.

13. Governing Law

These Terms are governed by UK law. Any disputes will fall under the jurisdiction of UK courts.

14. Indemnity

You agree to indemnify and hold Formby Bubble Limited harmless against any claims, damages, or costs arising from your use of the Service, your content, or your breach of these Terms.
