Formby mum of five is a prisoner in Britain because of a mistake on her birth register

Kim Walmsley told Good Morning Britain she's a "prisoner" in UK and claims marriage was declared illegal

Kim Walmsley’s nightmare began thirteen years ago when the family were emmigrating to Australia and they needed a duplicate birth certificate for Kim.

After requesting a copy of her birth certificate, Kim from Formby discovered, to her horror, that she had in fact been wrongly been registered as a boy, in 1965.

Astoundingly, the mum-of-five has also been told by the Archbishop of Canterbury that her 23-year marriage to husband Jack is not legal in the eyes of the Church.

Kim, who continues to appeal to Prime Minister David Cameron to help rectify the bureaucratic nightmare, has spoke of her life now, as a prisoner in the UK. Kim cannot get a passport without committing perjury on the passport application.

Kim was even on Good Morning Britain in 2014 in the hope that they might be able to help her but, her misery is STILL going on.

"It is not just me that is suffering, my children and my husband have also suffered. We used to have two foreign holidays every year but, since my passport ran out, they will not allow me to have another one, because I now have a 'Boy' birth certificate. I have family abroad and miss them so much. Surely it is illegal to keep me a prisoner in the UK".

"David Cameron has never once responded to any of my letters. I even went to Downing Street to hand deliver a letter but all to no avail. I am being held a prisoner in my own country and no-one wants to help!"

"I have even wrote to the HRH The Queen but, due to her being a constitutional Queen, she passed the book as well."

Kim's ORIGINAL birth certificate that her parents bought on the day they registered her at Waterloo Town Hall says 'GIRL'. This is the certificate that she has used her whole life to obtain a passport and for all other identification purposes.

The problem began when the mistake was discovered thirteen years ago. The mistake is in the Registrar's book and it says that Kim is a 'BOY'. All duplicate certificates MUST BE AN EXACT COPY OF THE REGISTRARS ENTRY BY LAW. She was then given a brand new birth certificate that says 'BOY'. This is now her LEGAL BIRTH CERTIFICATE. Her original certificate that says 'GIRL' is ILLEGAL and she is not allowed to use it.

The family had to return from their dream life in Australia when the couple couldn't renew Kim's passport after the mistake was discovered thirteen years ago

Since Kim's passport ran out nearly ten years ago, she has been a prisoner in the UK. Forced to return back from her dream life with her husband and five children in Australia, her ongoing battle to get the matter sorted continues.

A copy of Kim’s birth certificate bought by her parents in Liverpool in 1965 correctly states “girl” in the “sex” column. The corrections procedure for errors would add a note in the margin of her birth register which would confirm a mistake was made but, the mum says this won’t be accessible by all bodies and it will still be the original which is recognised by the court. The word 'BOY' will still be on the original entry.

Kim told Good Morning Britain: “My original birth certificate bought by my parents says girl. When we were applying to emigrate, we applied for a copy and then we realised I was registered as a boy."

“Unless the Prime Minister allows a change in the law to help me, It will never been changed. They can write a marginal entry or re-register my birth as if I was born to today but the problem with that is that there’s an annotation that always refers back to the original entry that will always remain the 'legal' entry which says boy!

"I believe it is my right, because I was born a girl, to have ‘boy’ removed completely and have girl put in its place. This was their mistake that I am still suffering for!"

'Mrs Walmsley's husband Jack said the couple have spent 'thousands of pounds on solicitors fees' trying to rectify the issue. The couple have five children Jack, 28, Harry, 26, Jimmy, 25, Charlie, 22, and twenty one-year-old Melissa.

Husband Jack told ITV presenters the clerical error is “ludicrous”. He said: “We have spent thousands of pounds on solicitors fees trying to sort the mess out. It now stands us at well over £150,000 and Kim is still a prisoner and still registered as a boy."

Kim has tried her local MP Bill Esterson and also her former MP Claire Curtis-Thomas but they only get so far and they have to back off. David Cameron is the only person that can sort this out so, she is now appealing to him again to help her.
